LorySue Terms of Use

LorySue Enterprises (LorySue) is a sole proprietorship located in Deer Park, Washington and is controlled and operated by LorySue Enterprises (or its authorized service providers/agents) from offices in the United States of America. By accessing any of these LorySue websites, you agree to be bound by these Terms of Use, all applicable laws and regulations (including export and re-export control laws), and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, do not use any of the LorySue websites. Any claim relating to LorySue's websites shall be governed by the laws of the State of Washington without regard to its conflict of law provisions. LorySue makes no representations or warranties that the materials contained on LorySue's websites are appropriate or available for use in all locations or territories, and access to such materials from locations or territories where their content is illegal is prohibited. Failure of LorySue to enforce any right(s) or provision(s) contained within these Terms of Use shall not constitute or be deemed to be a waiver of such right or provision nor prevent enforcement by LorySue of such right or provision thereafter.

The materials contained on LorySue's websites are protected by applicable copyright laws and trademark laws. Any unauthorized use of the materials appearing on LorySue's websites may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties. LorySue vigilantly enforces its intellectual property rights and will actively seek the recovery of any costs and damages it may incur preventing the misuse or misappropriation of its property.

All materials appearing anywhere on LorySue's websites are protected by worldwide copyright laws and treaty provisions. The copyright to such materials is held by LorySue Enterprises, or by the respective third party owner of the materials. None of the materials may be copied, reproduced, displayed, modified, published, uploaded, posted, transmitted, or distributed in any form or by any means other than as expressly permitted herein or with LorySue's express prior written approval. All rights not expressly granted herein are reserved.

Children, in no way, will be exploited through LorySue's website materials. If you have a child participating in an event and did not sign a release waiver prior to the event's photography (provided by the event coordinator), LorySue Enterprises is not liable for any action taken against LorySue Enterprises for the photography of said child at the public event. LorySue Enterprises only acts as agent to the event coordinator at events and is there by invitation of said event coordinator. Any action must first be successfully levied against event coordinators for any photogrpahic images taken during the course of the event by LorySue Enterprises and/or any of its agents. By participating in a public event and signing up to participate in public events, it is understood by LorySue Enterprises, that participants understand the event coordinator has invited LorySue Enterprises to photograph the event and sell said event photographs. No photograph will be sold to people other than those and/or immediate family members and/or owners of any subject in LorySue Enterprises' photos. LorySue Enterprises will never knowingly disseminate any sensitive information regarding children and stives to comply with The Children's Online Privacy Protection Rule (http://www.ftc.gov/os/1999/10/64fr59888.htm).

THE MATERIALS ON LORYSUE'S WEBSITES ARE PROVIDED "AS IS" WITHOUT ANY REPRESENTATIONS OR WARRANTIES WHATSOEVER. LORYSUE MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING SUCH MATERIALS AND LEXAR DISCLAIMS AND NEGATES ANY AND ALL REPRESENTATIONS AND WARRANTIES REGARDING SUCH MATERIALS, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OR OTHER VIOLATION OF RIGHTS. FURTHER, LORYSUE MAKES NO REPRESENTATIONS OR WARRANTIES CONCERNING THE ACCURACY, RESULTS, OR RELIABILITY OF THE USE OF THE MATERIALS ON ITS WEBSITES OR OTHERWISE RELATING TO SUCH MATERIALS OR ON ANY WEBSITES LINKED TO OR FROM LORYSUE WEBSITES.

IN NO EVENT SHALL LORYSUE OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR PROFITS, OR DUE TO BUSINESS INTERRUPTION,) ARISING OUT OF THE USE OR INABILITY TO USE THE MATERIALS ON LORYSUE'S WEBSITES, EVEN IF LORYSUE HAS BEEN NOTIFIED ORALLY OR IN WRITING OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, OR LIMITATIONS OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, AND THEREFORE THESE LIMITATIONS MAY NOT APPLY TO YOU.

LorySue does not represent or warrant that any of the materials on its websites are accurate, complete, or current. LorySue may make changes to the materials contained on its websites at any time without notice. LorySue does not, however, make any commitment to update such materials.
